1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Kuxel. We reserve the right to update these terms at any time without prior notice, with the updated date reflected at the top of this page.

2. Service Description

Kuxel is a platform that allows users to explore, search, save to favorites, and apply wallpapers for their mobile devices. The application offers both free content with advertising and premium features and exclusive content for premium users through in-app purchases.

3. Registration and Accounts

To access certain features (such as saving favorites to the cloud or syncing across devices), Kuxel allows registration through third-party providers (Google Sign-In and Apple Sign-In).

• Responsibility: You are responsible for maintaining the confidentiality of your account and all activities that occur under it.
• Cancellation: We reserve the right to suspend or cancel your account if you violate these Terms or engage in fraudulent activities.
• Cloud Favorites Retention: Wallpapers saved as favorites in the cloud associated with your account could be deleted from our servers after a period of 2 years from the last time you had an active Premium subscription or status.

4. In-App Purchases and Subscriptions

Kuxel may offer premium content or features through one-time purchases or subscriptions.

• Payment Processing: All payments are processed securely through the respective app stores (Google Play Store or Apple App Store).
• Renewal and Cancellation: Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. Cancellation must be managed through your app store account settings.
• Refunds: Refunds are subject to Google Play or Apple App Store policies. Kuxel does not process refunds directly.
• Subscription Transfer Between Accounts: Kuxel allows transferring an active Premium subscription and its associated favorites to another user account (email) within the Application, subject to the following terms:
  • Effects of transfer: The transfer results in the full migration of benefits and favorites to the destination account (email); the originating account (email) will immediately revert to the free tier with 0 saved favorites.
  • Security limitations: For security and fraud prevention purposes, only one (1) subscription transfer is permitted every 30 days per account (email).
  • Billing and cancellation management: The transfer does not alter the billing relationship with the underlying app store. The subscription, automatic renewals, and future charges will remain associated with the store account (Google Play Store or Apple App Store) used for the original purchase. Managing or canceling the subscription remains the sole responsibility of the original purchasing store account holder.

5. Intellectual Property and Copyright

• App Content: All wallpapers available on Kuxel are provided for personal and non-commercial use. Kuxel does not claim ownership of images provided by third parties or under public domain licenses, but does claim ownership of the code, design, and brand of the Application.
• Restrictions: The redistribution, resale, or commercial use of Kuxel content without the express authorization of the rights holder is prohibited. If you are a content creator and believe an image infringes your copyright, please contact us for its prompt removal.

6. Advertising and Analytics

Kuxel uses third-party services to improve your experience and monetize the application:

• Ads (AdMob / Google Mobile Ads): The free version includes ads. Ads may be customized based on your region and preferences.
• Analytics (Firebase): We collect anonymous usage data to improve application performance and understand how users interact with it.
• Notifications (OneSignal): We may send push notifications about new content or updates. You can manage these permissions in your device settings.

7. Limitation of Liability

Kuxel is provided "as is" and "as available". We do not guarantee that the application will be free of errors, interruptions, or security flaws. To the maximum extent permitted by law, Kuxel and its developers shall not be liable for direct, indirect, incidental, or consequential damages resulting from the use or inability to use the Application.

8. Modifications of the Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes through the Application or other reasonable means. Your continued use of Kuxel after changes are published constitutes your acceptance of them.

9. Applicable Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws applicable in your jurisdiction of residence, without giving effect to its conflict of law principles. Any dispute arising in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts.
